<p>How this will affect Mesa AZ real estate owners will depend on a person’s ability to avoid a foreclosure or short sale. With 50% of existing homes loans upside down, there is still rough seas ahead for homeowners.</p>
<p>Mesa AZ real estate owners may benefit from proposals before the Arizona legislature related to anti-deficiency calculations that could reduce liability for property owners who fall outside of the current anti deficiency protections.</p>
<p>In any event the tax man cometh. Mesa AZ real estate owners who do not act in 2012 may find themselves up against a large tax bill if they wait. Though a bill has been introduced to extend the Mortgage Forgiveness Tax Relief Act through 2015, the political water may not play to that end.</p>

			<content:encoded><![CDATA[<p>When a homeowner is facing foreclosure, it matters not that they live in Mesa or Glendale, Phoenix of Chandler, there are many questions that they will need answers to. One big concern hanging over the head of a distressed homeowner is, what future liability might I have? Unfortunately there is much misinformation that is floating around and much of this misinformation is conveyed by people who should be in the know.</p>
<p>Arizona’s anti-deficiency statutes found in A.R.S. 33-729 &#038; 833 only give limited protections to homeowners facing foreclosure. Since the protections are limited and not absolute there are many foreclosed homeowners who may face future financial liability. It is highly advised that homeowners facing foreclosure contact a competent attorney who specializes in real estate law.</p>
<p>What about the protection from anti-deficiency for people who attempt to complete a short sale? This is another big question that often gets answered incorrectly. This is one protection that you want to make sure you have correct before you find yourself without a house and still owing a large note to one of your lenders.</p>
<p>Finally there have been two recent court rulings that have expanded and clarified the protections under the Arizona Anti-Deficiency statutes. If you are building a home and cannot complete the project and are foreclosed upon there may be hope. </p>

			<content:encoded><![CDATA[<p>The Mesa AZ real estate market has seen many changes over the past few years. Most of the changes have been downward. About May of 2011 the home inventory in Mesa began to dry up about the same time buyers started to realize that prices were at or near the bottom.</p>
<p>Since September the Mesa AZ real estate market has seen positive numbers. The number of buyers has stayed strong and prices have been on a slow but steady climb. Home prices in Mesa have been helped by mom and pop investors, first time home buyers and out of state investors, all competing for the dwindling inventory. </p>
<p>Foreclosure listings are also down adding to the shortage of homes for sale in the Mesa AZ real estate market. Though banks have started to increase their aggressiveness again, post Government settlement, the inventory has not started showing up. The number of homes sold as short sales is up and is projected to continue that way in 2012 ahead of the expiration of the Mortgage Forgiveness Debt Relief Act.</p>
<p>The does not seem to be much help for Mesa AZ real estate home owners affected by the diminished housing values, as 52% of the homes are still underwater and only a small percentage of homeowners will even qualify for the highly restricted HARP 2.0 or the AG homeowner settlement. This mean that there will likely be more short sales and foreclosures coming in spite of the pre-election year gimmicks proposed and/or implemented in Washington D.C.</p>

In order to help struggling home owners, the president announce a reduction in the cost FHA streamline refinancing cost homeowners for the upfront for Mortgage Insurance by 90% and the cost of required monthly mortgage Insurance by 50%.</p>
<p>On the surface this sounds like a positive step to help homeowners who have higher than current market rate interest on current home loans, refinance into much lower interest rates. The additional benefit would be removing the burden of high upfront and ongoing mortgage insurance costs.</p>

<p>But wait! Is this really a positive step or just another BAILOUT? HUD (Housing and Urban Development) has been under the gun with its FHA mortgage insurance reserves. How will lowering the cost of the FHA mortgage insurance for homeowners who can afford to keep their homes help?</p>
<p>Not to worry because President Obama’s plan has a fix. Since the housing market has fully recovered, an initiative to raise the mortgage insurance rates home buyers pay when purchasing a new home and using FHA financing is part of the plan. The only problem is that the housing market has not recovered. In fact the housing market nationwide is flat, and Arizona is just starting to show signs that it might stabilize.</p>

<p>Foreclosures and short sales have created nationwide issues for which the government has attempted to minimize through program. This act was intended to keep people who lost their homes to foreclosure or short sale avoid the addition of a huge IRS tax bill to boot.</p>
<p>2012 is anticipated to be the largest year for short sales and one reason people are opting to sell now is that the Mortgage Forgiveness Debt Relief Act of 2007 will expire December 31, 2012. When the tax relief protection ends, homeowners faced with foreclosure and short sales will also face income tax on the forgiveness of debt at their normal tax rate.</p>

Mesa Arizona is the 37th largest city in the country and as such has many of the challenges faced by other large cities. <p>Often we overlook the condition within our inner cities and focus on our lives outside these core areas. Inner city Mesa Arizona’s real estate is not exempt. With housing values being down over 50% compared to just a few years ago, homeowners are facing the reality of needing to short sales or foreclosure. Large numbers of investors in Mesa have been buying homes at large discounts. </p>
<p>When investors begin to dominate a community there is harm that can come from it. We see lower levels in ownership pride and engagement in the local community. When owners dominate a community they take greater pride in keeping and improving their home and thus their community. Owners spend more time volunteering, more time helping in communities and assisting in local schools. Homeownership leads to more local jobs as homeowners spend more money improving and maintaining their homes than renters do. Inner city stabilization in Mesa Arizona real estate will help to bring about recovery.</p>
<p>At the forefront of helping to bring about stabilization of home ownership in the inner city is a non-profit organization that is making a difference throughout the Phoenix-Mesa valley. The National Association of Hispanic Real Estate Professionals (“NAHREP”) is helping the Hispanic community with sustainable homeownership. This makes perfect sense since a large population of people who are of Hispanic decent are living in the inner cities in Arizona. Mesa Arizona real estate price recovery needs to start in these core inner city areas where prices have been driven down for the rest of the market to begin to see real positive change.</p>
<p>While Interviewing Grey Sehnert, President of NAHREP Arizona Chapter and Gail Buck, Former President and Chairman Emeritus of NAHREP Arizona Chapter, we discusses how NAHREP-AZ  has taken a hands on approach. A perfect example of NAHREP’s influence can be seen in one Phoenix community we known as Maryvale. Maryvale is a planned community development  within the city or Phoenix. Located in Maryvale is the major league baseball spring training facility of the Milwaukee Brewers. This area has been one of the hardest hit locations anywhere in the Phoenix-Mesa valley. NAHREP-AZ has put on charity events to raise money for student athletes, sports facilities and school programs. At the fore front is NAHREP education of real estate professionals to be capable of providing home affordability and sustainability services to home buyers and foreclosure alternatives to homeowners. </p>
<p>Mesa Arizona real estate can plan on seeing a strong recovery if we can manage to stabilize the inner city through sustainable homeownership. Then we will see stabilized prices on these lower priced homes located in the inner city communities and price stabilization on homes in neighboring communities as well.</p>
